Living Atlantic is a short-term letting and property management business based in Cape Town, South Africa, owned by Trish Parsons. We manage a collection of furnished properties for their owners and let them to guests. In these terms, “we”, “us” and “our” mean Living Atlantic, and “you” means anyone using the website.

You may use this website for lawful purposes only, to look at our properties, learn about our services and contact us. You must be at least 18 years old to make a booking request or enter into an agreement with us.

You agree not to:

• use the website in any way that is unlawful, fraudulent or harmful;
• send us false, misleading or another person's details;
• use automated tools to collect content from the website or to submit our forms repeatedly;
• attempt to interfere with the website's security or normal operation; or
• copy, resell or republish our content without our written permission.

We work hard to keep descriptions, photographs, amenities, ratings and prices accurate and current. Information on the website is a guide. Photographs show the property as it is intended to be presented, and small differences such as furnishings, decor or views may occur.

Showing a property on the website does not mean it is available on any particular dates. Availability is confirmed only when we reply to your request.

The Book Direct form on a property page is a request, not a booking. Sending it does not reserve the property and does not oblige you or us to proceed. No payment is taken on the website.

A booking is made only when we confirm availability and our price in writing and you accept it, together with any deposit, payment terms, cancellation conditions and house rules set out in that quote or confirmation. Those written terms form part of your booking.

The figures shown in the request form are estimates calculated from the nightly rate displayed on the property page and any cleaning fee. They are not an offer and can change with the season, demand, length of stay and availability. A price binds us only once it appears in our written quote. Where the website shows a direct booking price, it applies to stays booked directly with us and confirmed in a written quote.

Some properties can also be booked on Airbnb, Booking.com or Lekkeslaap. If you book through one of those platforms, your booking is governed by that platform's terms, prices and cancellation rules, and not by these terms. We are not responsible for the platform's services.

If you stay in one of our properties, you agree to use it respectfully and lawfully, to keep to the maximum number of guests confirmed in your booking, to follow the house rules provided to you, and to treat the property, its contents and its neighbours with care. You are responsible for loss or damage caused by you or your party beyond fair wear and tear, as set out in your booking confirmation.

An enquiry from a property owner is an invitation to talk and creates no obligation on either side. If we manage your property, we will do so under a separate written management agreement, and that agreement governs our services, fees and responsibilities.

Statements on this website about pricing, occupancy, performance or returns are general and illustrative. Results depend on many factors, and nothing on the website is a guarantee of income.

Trish Parsons is also a property practitioner (Harcourts Atlantic, FFC No. 1139775). Property sales, purchases and investment property enquiries are handled by her in that capacity, under the terms of her agency and the Property Practitioners Act 22 of 2019, and separately from our letting and management services.

Nothing on this website is financial, legal or tax advice. Please obtain independent advice before making an investment or property decision.

The guest reviews and ratings shown on the website come from reviews guests have left on platforms such as Airbnb. They are the views of those guests, and we do not edit what a guest wrote. Ratings are calculated from the reviews we hold and may change.

The website, including its design, text, photographs, logos and the Living Atlantic name, belongs to us or is used with permission, and is protected by copyright and other laws. You may view the website and print or download pages for your personal use. You may not copy, adapt, distribute or use our content or brand for any other purpose without our written permission.

The website contains links to websites run by others. We do not control them, and a link is not an endorsement. We are not responsible for their content, availability or practices.

We provide the website on an “as is” and “as available” basis. We do not promise that it will be uninterrupted, error free or free from harmful components.

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss arising from your use of, or inability to use, the website or from reliance on its content. Our responsibility for any stay is as set out in your written booking confirmation.

Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot lawfully be limited, and nothing excludes liability for gross negligence, fraud or intentional wrongdoing.

How we collect and use your personal information is set out in our Privacy Policy, which forms part of these terms.

We may change the website, and update these terms, from time to time. The date at the top shows when they were last changed. A booking you have already confirmed remains subject to the terms that applied when it was confirmed.

These terms and our written quote or booking confirmation make up the whole agreement between you and us about your booking. If any provision is found to be invalid or unenforceable, the rest remains in force. If we do not enforce a right straight away, that does not mean we have given it up.

These terms are governed by the laws of the Republic of South Africa, and the South African courts, including the courts in Cape Town, have jurisdiction over any dispute, subject to any right you have as a consumer to approach another forum.
